Terms and Conditions

1) Overview

These Terms govern your access to and use of Nubian Divinity’s website and services, including tarot readings, equity consulting, and doula support (collectively, the “Services”). By booking, attending, or using our site, you agree to these Terms.

2) Eligibility

You must be at least 18 years old and able to form a binding contract. If you are booking doula services, you confirm that you understand doulas provide non‑medical support and do not replace clinical care.

3) Booking, Rescheduling & Cancellations

  • Virtual sessions: All sessions are conducted online (e.g., Zoom). A link will be sent after booking.
  • Scheduling: Book via our online scheduler. Times are shown in your local time where supported.
  • Rescheduling: You may reschedule 1 time up to 24 hours before the start time via the confirmation email or by contacting us.
  • Cancellations & refunds: Cancel 24 hours or more before the start time for a full refund. Cancellations within 24 hours and no‑shows are non‑refundable.
  • Late arrivals: If you are late, your session may still end at the scheduled time and will be charged in full.
  • Provider changes: We may reschedule, refuse, or cancel a session for safety, appropriateness, or other reasonable cause; you will receive a refund where required.

4) Fees & Payment

  • Prices are listed at booking and may change prospectively.
  • You authorize us and our payment processor(s) (e.g., {{Stripe/PayPal}}) to charge your selected payment method.
  • No deposit is required unless otherwise noted at booking.
  • You agree not to make fraudulent or abusive chargebacks.
  • You are responsible for any applicable taxes.

5) Service‑Specific Disclaimers

  • Tarot & spiritual guidance: Intended for personal insight and reflection. Not a substitute for professional legal, medical, financial, or mental‑health advice. Seek licensed professionals for those needs.
  • Equity consulting: Advisory services provide recommendations; outcomes depend on your organization’s actions and context. No guarantee of specific results.
  • Doula support: Non‑medical emotional, physical, and informational support. Doulas do not perform clinical tasks, diagnose, or provide medical care. In an emergency, call local emergency services.

6) Client Responsibilities

  • Provide accurate information, participate respectfully, and use the Services lawfully.
  • Do not record sessions without prior written consent.
  • Ensure you have a stable internet connection and a private space for virtual sessions.
  • For consulting engagements, ensure decision‑makers are available and provide necessary access to information.

7) Intellectual Property

The website, brand assets, content, and materials we provide (including session materials and resources) are owned by us or our licensors and protected by law. You receive a limited, non‑transferable license to use materials for your personal or internal business purposes only. You may not copy, distribute, or create derivative works without written permission.

8) User Content & Testimonials

If you submit feedback, testimonials, reviews, or other content, you grant us a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display it for marketing and operational purposes, subject to our Privacy Policy.

9) Prohibited Uses

You agree not to misuse the Services, including by harassing others, attempting to breach security, reverse‑engineering the site, scraping without permission, or using the Services for unlawful purposes.

10) Third‑Party Services

We may provide access to third‑party tools and links. We are not responsible for third‑party content, policies, or actions. Your use of third‑party services (e.g., Zoom, payment processors, schedulers) is governed by their terms.

11) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR‑FREE.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE SERVICE IN THE {{3/12}} MONTHS BEFORE THE CLAIM AROSE.

13) Indemnification

You agree to indemnify and hold harmless Nubian Divinity, its owners, and personnel from and against claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.

14) Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑laws principles. The parties submit to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario, Canada. Each party waives any objection to jurisdiction or venue on the grounds of inconvenience.

15) Changes to the Services or Terms

We may update these Terms at any time. The “Last updated” date will change and, where appropriate, we will provide additional notice. Continued use after changes means you accept the updated Terms.

Together, you’ll create a path that honours your values, your culture, and the legacy you want to leave behind.
